DESCRIPTION AND AVAILABILITY OF PRODUCTS
Each Product purchased is sold subject to its Product Description which includes any specific Conditions related to that Product including estimated delivery dates, warranties and after-sales service. We have made every effort to display our products as accurately as possible with details, descriptions, sizes, images and prices. We will take reasonable care to ensure that all descriptions are correct at the time when the relevant information is entered onto the system and updated as necessary. Due to individual batches, new lines and the variation of colours displayed on your monitor, we cannot guarantee that the products will be exactly as seen on your monitor and browser. Although we aim to keep the Website as up to date as possible, the information including Product Descriptions appearing on this Website at a particular time may not always reflect the position exactly at the moment you place an order. We cannot confirm the price of a Product until your order is accepted in accordance with our Order acceptance policy. For certain goods, information concerning stock availability is not available on the Website. We endeavour to keep all other availability information as up to date as possible; however it will be subject to change. We will do our best to contact you in the event of changes affecting an order you have placed. Acceptance of your order and the formation of a contract between us will take place when we send you an email confirming that the goods you have ordered have been despatched to you unless we have notified you that we do not accept your order or you have cancelled it in accordance with our Cancellation & Returns Policy. PRICES AND PROMOTIONS
All prices and charges are quoted in UK £ sterling. They include any VAT payable but exclude postage and packaging charges unless otherwise stated and until the payment processing stage. You will be told the total price of the transaction before you complete your purchase. There are no hidden extra costs. We are not responsible for any other importation taxes, sales taxes or charges that may be levied at the delivery destination. Although we endeavour to ensure that all pricing information on the Website is accurate, in the rare event that a Product is incorrectly priced on the Website, we reserve the right not to supply that item. We will, at our discretion, either contact you and ask you whether you wish to continue with the order at the correct price or notify you that we have cancelled your order. We will not be obliged to supply goods at the incorrect price. Prices that are reduced for sales and promotions are only valid for the specified period. We reserve the right to adjust prices, offers, goods and specifications of goods on the Website at our discretion at any time before (but not after) we accept your order.

An order can be made by telephone or via email or Website form. We do not take orders directly via the Website yet and so do not take card details but this is something we aim to add in the future. We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website. All orders made by you through the Website are subject to acceptance by us. We may choose not to accept your order for any reason and will not be liable to you or to anyone else in those circumstances. After submitting an order to us we will send you an order acknowledgement email with your order number and details of the goods that you have ordered. Please note this email is an acknowledgement and is not an acceptance of your order. If you wish to order goods which may only be purchased by persons of a certain age, you will be asked when registering on the Website to declare that you are of the appropriate legal age to purchase the items. If we reasonably believe that you are not legally entitled to order certain goods, we reserve the right to cancel your order.

ACCEPTANCE OF ORDER
We reserve the right to withdraw any Products from this Website at any time and/or remove or edit any materials or content on this Website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any Product from this Website whether or not that Product has been sold; removing or editing any materials or content on the Website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun. To be eligible to purchase Products on this Website and lawfully enter into and form contracts on this Website under English law you must:
1. Provide your real name, phone number, e-mail address, payment details and other requested information
2. Be over 18 years of age.
3. Stipulate a delivery address in the United Kingdom. Please note that PO box numbers, hotels and accommodation addresses are not acceptable.
By making an offer to buy a Product, you specifically authorise us to transmit information (including any updated information) or to obtain information about you from third parties from time to time, including but not limited to your debit or credit card number or credit reports, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions. Non-acceptance of an order may be a result of one of the following:
1. The product you ordered being unavailable from stock.
2. Our inability to obtain authorisation for your payment.
3. The identification of a pricing or product description error.
4. You not meeting the eligibility to order criteria set out in the main Terms & Conditions.

DELIVERY
Notification of despatch of goods may be confirmed via email. Once this email has been sent we may not be able to change any delivery details. Therefore, it is your responsibility to ensure that you are happy with the details in the email acknowledgement of your order. If you request any different or specific delivery times, please contact us by replying to our email acknowledgement, by emailing us at info@mosskillers.co.uk. or by telephone on 01673 866677. We cannot promise that we will meet all of your requirements, but will make every effort to do so. If we cannot despatch a Product to you within the specified time we will notify you and at your request we will cancel the order and refund your money in full. Any date or period for delivery shall be considered as indicative. Different Products may have different delivery times. We will usually await availability of all Products prior to despatch and an email will be sent to you as confirmation. You can contact us if you would like the Products despatched at different times. We are only able to deliver to addresses in the United Kingdom and the Channel Islands. Orders will be sent to the delivery address that you give us at the order or registration process. We cannot be held responsible if this delivery address is incorrect. If you wish to change your delivery address prior to despatch of goods when the order is "IN PROGRESS" you must contact the Customer Services team to ascertain if this is possible. We will use our reasonable endeavours to ensure that the estimated delivery times are met but we cannot accept any liability for late deliveries which are due to circumstances outside of our reasonable control. We will not be responsible for delays in the delivery caused by any third party. If a Product is not received after a reasonable time, please contact us to ascertain its location. If lost in transit, you must follow the instructions that we will give to you to confirm non-receipt, whereupon, the order may be cancelled or a replacement sent free of further charge. Once a Product has been signed for at the delivery address, it is no longer our responsibility and all risk of damage to, or loss of, the goods shall pass to you. Refunds will not be given if your gift is not passed to the main recipient. If you intend to cancel your order in accordance with the Cancellation & Returns Policy, you must keep good care of the goods pending their return to us and ensure that they are packaged correctly for return. We reserve the right to refuse a cancellation if the Product is deemed unfit for resale.

ACCEPTANCE
The Customer must inspect the goods on receipt. (This does not however affect the customers's statutory rights).

GOODS DAMAGED IN TRANSIT
If, on delivery, a Product is found to be damaged or faulty, you are to confirm this on the delivery note where applicable and inform us within 7 working days. If you do not inform us within 7 working days, we will have no liability for a Product said to be damaged/faulty on delivery. Any faulty Product is to be returned to us via Recorded Delivery in its original packaging. When returning goods, please provide the order number, your name and address, the original invoice and return to us at the address on the page. We will reimburse these extra postage costs. We will also give you the option of cancelling the order and receiving a full refund or arranging a replacement of the faulty items.

CANCELLATIONS AND RETURNS
Should you wish to cancel or return any of your goods, you may only do so in accordance with our Cancellation & Returns Policy. Any contract can be cancelled with a money back guarantee as long as we have been notified within 7 working days of receipt of goods. The Products are to be returned to us at your own expense (unless damaged or faulty) in original packaging via Recorded Delivery. We will offer a full refund as long as the Products are unused and in merchantable condition for resale. Please note that postage costs on the original order are not refunded unless the Products are damaged or faulty. We want all our customers to be completely satisfied with our service. We will be fair and handle your complaint confidentially. You will receive an acknowledgment within 3 working days and we will provide a timescale for resolving the dispute and keep you notified of progress. SEVERANCE

Each provision of these Terms and Conditions of Sale shall be construed separately and independently of each other and the validity and enforceability of any one part shall not affect the validity and enforceability of any other part.

LAW
These Terms and Conditions are governed and shall be interpreted in accordance with the laws of England and Wales and you agree to submit to the non-exclusive jurisdiction of the English courts. We are required by law to inform you that sales can be concluded in English only and that no public filing requirements apply.
